Abstract
The present predominant comprehension of “autonomy” in terms of Medical Law and Medical Ethics in the “western” individualistic- shaped understanding is not one as a normative right but as an empiric ability. The category of capacity to consent states the legal framework in order to grant or deny a person’s - objective - competence of making a “autonomous” decision. This understanding, however, does not only lead to grave difficulties in the application, it also misses existential preconditions of human being in a “co-operative” doctor-patient-relation from the outset.
